We have almost finalized the purchase of our pup and she is supposed to ship to us tomorrow. We just received the contract and it has a statement that says:
"The puppies are sold with a no breeding agreement, therefore no pedigree. Our puppies are not for breeding purposes."

This is the only (and first) mention of a no breeding agreement, how binding is this? We do not have any solid plans to breed however we would like to keep the option for one litter open for future.

I have seen spay/neuter contracts or limited papers, however since this puppy is being sold with no pedigree and no spay contract, how binding is that statement?

Thanks :)

It is a contract so I suppose you could potentially get sued. I had a limited registration for Jax which meant no breeding but I still got his AKC papers.

I have no idea how binding it is, but I'd ask them for the pedigree history and why they waited until this late in the deal to say no breeding!

davidh may have some insight .... but, I believe if you sign it, you can be sued if you break the contract agreements

I don't understand any good reason for them not to provide a pedigree, but maybe I am missing something. Our last dog came with a no-breed/spay agreement, but we were still provided all the paperwork to be able to get her AKC registered. Our current pup didn't require that, although we plan on neutering him eventually, and will not breed him. Personally, I feel like more puppies should be sold with a no-breed agreement, but that is another subject.

They should have told you up front that their pet pups are not to be breed, and give you a limited registration. We do this on our pet pups. If I found out someone had breed one of my pet pups, I will sue them for breach of contract. I would also sue to try to get my dog back. People who deceive me and go against what we agreed on and break our contract, do not deserve my dogs. I take my dogs and breeding program very seriously, as do several of the breeders I know. We try to be very careful who we let have ours dogs. I would assume the breeder you are buying from is the same way, especially if they are a reputable breeder.
